Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you (the clinic, healthcare provider, or authorised representative) and Aurvikon ("we", "us", "our"), governing your access to and use of the Clinic AI platform available at app.aurvikon.com and all associated services, APIs, and integrations ("the Service").
By creating an account, clicking "I agree", or accessing or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
- You must be at least 18 years old to create an account.
- You must be authorised to accept these Terms on behalf of the clinic you register.
- You must provide accurate and complete registration information and keep it current.
- Each clinic account is for a single clinic location unless otherwise agreed in writing.
2. Services Provided
Aurvikon provides software-as-a-service (SaaS) tools designed to help clinics automate and streamline their operations, including:
- WhatsApp appointment automation — patients can book, reschedule, and cancel appointments through a conversational WhatsApp chatbot.
- Automated reminders & follow-ups — scheduled messages sent before appointments and after visits.
- Clinic dashboard — a web-based dashboard for managing appointments, patient records, follow-up tasks, and billing.
- WhatsApp Business integration — connect your own WhatsApp Business number via Meta Embedded Signup (available on Pro and Premium plans).
- Document generation — prescription and invoice templates for clinic use.
Aurvikon reserves the right to add, modify, or discontinue features at any time. We will make reasonable efforts to notify users of significant changes to the Service.
Important — Not a Medical Service:
- Aurvikon is an operational automation tool. We do not provide medical advice, diagnosis, treatment recommendations, or prescriptions.
- Our AI assistant handles only appointment scheduling, rescheduling, cancellation, clinic information, reminders, and message routing.
- The clinic is solely responsible for all medical decisions, patient care, accuracy of medical documents (prescriptions, invoices), and compliance with applicable medical and healthcare regulations.
- Patients should always consult their healthcare provider for medical concerns and call local emergency services (112) in a medical emergency.
3. User Responsibilities
3.1 Account Security
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at autoclinicbotz@gmail.com if you suspect any unauthorised access or breach.
3.2 Clinic Data Accuracy
- You are responsible for the accuracy of clinic information, business hours, doctor details, appointment slots, and any content configured on the platform.
- You are responsible for ensuring that patient data you upload or manage through the platform complies with applicable data protection laws (including DPDP Act, 2023, where applicable).
- Aurvikon is not liable for errors arising from inaccurate information provided by you.
3.3 Regulatory Compliance
You are solely responsible for ensuring your clinic's operations, communications, documentation, and use of this platform comply with all applicable laws, medical regulations, and professional licensing requirements in your jurisdiction.
4. WhatsApp and Third-Party Platform Usage
Use of Aurvikon's WhatsApp integration is subject to Meta's Business Messaging Policy, WhatsApp Commerce Policy, and any other applicable Meta/WhatsApp platform policies, in addition to these Terms. By using the WhatsApp features in this platform, you also agree to comply with those policies.
- 24-hour messaging window: Free-form messages can only be sent to a patient within 24 hours of their last inbound message. Outside this window, only pre-approved WhatsApp message templates may be used.
- Clinics must ensure their message templates and patient communications comply with WhatsApp's content and commerce policies at all times.
- Aurvikon is not responsible for message delivery failures caused by Meta, WhatsApp, network issues, or the patient's device configuration.
- Clinics must not use the service to send promotional or marketing messages unless expressly permitted under WhatsApp policies and with proper patient consent.
- If you connect your own WhatsApp Business number via Meta Embedded Signup (Pro/Premium plans), you are responsible for maintaining that WhatsApp Business Account in compliance with Meta's platform terms. Loss of access to your Meta Business Account may affect your ability to send or receive messages through Aurvikon.
- Third-party integrations (Google, Razorpay, Meta) are governed by their own terms and privacy policies. Aurvikon is not responsible for their availability, functionality, or changes to their policies.
5. Billing and Subscriptions
5.1 Subscription Plans
- Subscription fees are billed monthly or yearly through Razorpay.
- Prices are listed in Indian Rupees (INR) and include applicable taxes.
- Paid plans renew automatically according to the selected billing cycle (monthly or yearly) unless cancelled before the renewal date.
- We reserve the right to change pricing with at least 30 days' notice to existing subscribers. Continued use after notice constitutes acceptance of the new pricing.
- Failure to pay may result in suspension or termination of your account.
5.2 Plan Changes
You may upgrade or downgrade your plan at any time from your dashboard. Upgrades take effect immediately; downgrades take effect at the start of the next billing cycle. Refer to our Refund & Cancellation Policy for details on cancellations and refunds.
6. Trial and Plan Limitations
6.1 Free Trial
New clinics receive a 7-day free trial with access to the platform features available under the plan selected at sign-up. No payment information is required to start the trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. Trial access may be revoked earlier if misuse is detected.
6.2 Plan Feature Limits
- Certain features — including connecting your own WhatsApp Business number — are exclusively available on Pro and Premium plans.
- Usage limits (such as the number of patients, conversations, or documents) may apply depending on your plan. These limits are described on the pricing page.
- Aurvikon reserves the right to enforce plan limits and may restrict access to features beyond your plan's scope without prior notice.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect data. By using the Service, you consent to data processing as described therein.
- You retain ownership of your clinic's data, patient records, and uploaded documents. You grant Aurvikon a limited license to process this data solely for the purpose of providing the Service.
- We implement appropriate technical and organisational measures to protect your data. However, no system is completely secure; you share data with the Service at your own risk.
- Patient data must only be uploaded or processed through the platform with the appropriate consent of the patients as required by applicable law.
- Upon account termination, your data will be retained for up to 90 days before permanent deletion, as described in the Privacy Policy. You may request earlier deletion at autoclinicbotz@gmail.com.

8. Service Availability
- We aim to maintain high availability but do not guarantee uninterrupted or error-free service.
- Scheduled maintenance will be communicated in advance when reasonably possible.
- Aurvikon is not liable for downtime or degradation caused by third-party services (Meta, Razorpay, hosting providers, internet infrastructure) or events outside our reasonable control.
9. Prohibited Use
You must not use the Service to:
- Engage in any unlawful, fraudulent, or deceptive activity.
- Send spam, unsolicited bulk messages, or marketing communications that violate WhatsApp's policies or applicable anti-spam laws.
- Attempt to access other clinics' data, bypass authentication, or exploit security vulnerabilities.
- Upload or transmit malicious code, viruses, or harmful content.
- Misrepresent your clinic's identity, credentials, qualifications, or medical specialisations.
- Use the platform to provide, simulate, or imply medical diagnosis, treatment advice, or prescriptions through the AI chatbot.
- Resell, sublicense, or redistribute the Service or access to it without our prior written permission.
- Violate any applicable Meta, WhatsApp, Google, or Razorpay platform policies while using features powered by those services.
- Harass, abuse, or harm patients, staff, or any third party through communications facilitated by the platform.
10. Limitation of Liability
- Aurvikon provides the Service on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
- To the maximum extent permitted by applicable law, Aurvikon's total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount paid by you to Aurvikon in the three (3) months immediately preceding the event giving rise to the claim.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, business opportunities, or goodwill.
- We are not liable for missed appointments, failed message deliveries, clinical outcomes, regulatory penalties, or any harm arising from your use of or reliance on the platform.
11. Termination
- You may cancel your account at any time by contacting us at autoclinicbotz@gmail.com or through your dashboard settings.
- We may suspend or terminate your account immediately, with or without notice, if you violate these Terms, engage in abusive or illegal behaviour, send spam, or fail to pay subscription fees.
- We may also suspend accounts that violate Meta, WhatsApp, or other integrated platform policies, to protect the integrity of our shared platform access.
- Upon termination, your access to the Service will be revoked. Your data will be retained for up to 90 days as described in our Privacy Policy, after which it will be permanently deleted.
- Provisions of these Terms that by their nature should survive termination (including limitations of liability, indemnity, and governing law) shall continue to apply.
12. Changes to Terms
We may update these Terms from time to time to reflect changes in law, our business practices, or the features of the Service. When we make significant changes, we will notify registered clinic accounts via email and post the revised Terms on this page with an updated "Last Updated" date. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms.

Disputes are subject to the exclusive jurisdiction of the courts in Indore, Madhya Pradesh, India, and are governed by the laws of India.
